Terms of Service

These Terms of Service (“Terms”) govern your use of the Keystone HSE service. By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.
1. Who we are
Keystone HSE is a trading name of Tom Redman, a sole trader registered in Jersey (the “Provider”, “we”, “us”). Business address: 9 Grosvenor Terrace, St Helier, Jersey JE2 4QS. Legal contact: legal@keystonehse.com.
2. The service
Keystone HSE is a software-as-a-service platform that helps construction sub-contractors generate Risk Assessments, Method Statements, COSHH assessments, lifting plans and related health-and-safety documentation. The service is provided over the internet at app.keystonehse.com.
The service is provided to you for your business use only. Keystone is not a substitute for a qualified health-and-safety advisor and you remain responsible for the accuracy and suitability of any document you produce using the service.
3. Account & eligibility
You must be at least 18 years old and authorised to bind your business to these Terms. You agree to provide accurate signup information and to keep your account credentials secure. You are responsible for everything that happens under your account.
4. Subscriptions, trials and payment
The service is offered on monthly subscription plans (currently “Solo”, “Pro” and “Team”). Plans, prices and monthly RAMS allowances are published at keystonehse.com/pricing.
Trial period. New accounts receive a 14-day free trial. A payment card is required at signup but you will not be charged during the trial. You may cancel at any time during the trial to avoid being charged.
Billing. Subscriptions automatically renew each month at the published price for your plan. Payment is processed by Paddle.com Market Limited acting as Merchant of Record. By providing payment details you authorise Paddle and us to charge your card at the start of each billing period.
Failed payments. If a renewal payment fails, your account will be placed in “past due” status and generation of new RAMS will be disabled until payment succeeds. We may suspend or terminate your account if payment cannot be collected within a reasonable period.
Refunds. See our Refund Policy. In summary: no refunds are offered once a billing period has begun. You may cancel at any time to prevent further renewals.
Price changes. We may change prices on existing plans. We will give at least 30 days’ notice before any price change affects your subscription, and you may cancel before the new price takes effect.
5. Your content
Anything you upload to or generate within Keystone — risk assessments, safe working practices, COSHH data, MSDS files, certificates, project information — is your content (“Customer Data”). You retain all ownership and intellectual-property rights in your Customer Data.
You grant us a limited, non-exclusive licence to host, process and display your Customer Data solely as necessary to provide the service to you. We do not use your Customer Data to train AI models, advertise to third parties, or share with anyone other than the sub-processors listed in our Privacy Policy.
6. Acceptable use
You agree not to:
- Use the service for any illegal purpose or to produce documents containing knowingly false information;
- Reverse-engineer, decompile or attempt to extract the source code of the service;
- Resell or sub-license access to your account without our written permission;
- Submit content that infringes any third party’s rights or violates UK or Jersey law;
- Attempt to interfere with the operation of the service, including by submitting malicious files, attempting to overwhelm our infrastructure, or probing for vulnerabilities without prior written authorisation.
We may suspend or terminate accounts that violate this section.
7. Our intellectual property
The Keystone HSE platform, including its design, software, templates, generated default content (the “starter library”), and branding, is owned by the Provider and protected by applicable copyright, trade-mark and other laws. Your subscription does not transfer any ownership of the platform to you.
8. AI-generated content
The service uses AI to tailor RAMS content. AI output is not infallible. You are responsible for reviewing every document Keystone produces before using it. Keystone’s “Polish” and “Analyse” features are aids, not approvals.
9. Service availability
We aim to keep the service available 24/7 but do not guarantee uninterrupted access. We may carry out planned maintenance and will make reasonable efforts to give advance notice. We are not liable for service interruptions caused by events outside our reasonable control.
10. Disclaimer of warranties
The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. You assume full responsibility for verifying the suitability of any document produced through the service for your specific site, project or regulatory context.
11. Limitation of liability
To the maximum extent permitted by law, the Provider’s total liability to you for any claim arising out of or relating to these Terms or the service is limited to the amount you paid us for the service in the 12 months immediately before the event giving rise to the claim. The Provider is not liable for indirect, consequential, special, incidental, exemplary or punitive damages, or for loss of profits, revenue, business, data or goodwill.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless the Provider against any claims, losses or expenses (including reasonable legal fees) arising out of your use of the service in breach of these Terms, your Customer Data, or your use of any document you produce through the service.
13. Termination
You may cancel your subscription at any time from the billing portal or by emailing legal@keystonehse.com. Cancellation stops further renewals; the current billing period is not refunded. After cancellation your account becomes read-only for a short grace period (see Privacy Policy for retention details) before data is permanently deleted.
We may terminate or suspend your account for material breach of these Terms, non-payment, or where we are required to do so by law.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or in-app at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
15. Governing law & jurisdiction
These Terms are governed by the laws of the Bailiwick of Jersey. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Jersey.
